Transfers & Writs

With a few exceptions, the Supreme Court of Missouri is a court of discretionary review. It may choose whether to transfer a case from the Court of Appeals, and it does so to resolve a conflict among the three districts of the Court of Appeals, to reexamine existing law, or, most commonly, because the case involves a question of general (statewide) interest and importance. When the Supreme Court takes transfer of a case after an opinion from the Court of Appeals, it reviews the decision of the circuit (trial) court, not, except in rare cases, the decision of the Court of Appeals. The Court also has original jurisdiction to issue extraordinary writs. Transfer and writ orders are issued on regular hand down days.
